A Spanish court has awarded €13.3 million in compensation to the parents of Neizan, a child left with severe disabilities due to medical negligence during birth. The ruling marks the highest payout of its kind in Spain after doctors failed to detect critical complications in time. Neizan was born in a critical condition, with no spontaneous breathing, a weak heartbeat, and dangerously low blood pressure. His dire state resulted from oxygen deprivation during delivery, caused by medical staff’s failure to properly monitor fetal distress. The court found that clinicians had misinterpreted key signs and delayed intervention, leading to irreversible brain damage.

The child spent 35 days in intensive care after birth. He was later diagnosed with cerebral palsy, epilepsy, vision impairment, and severe feeding difficulties. His disability rating now stands at 87%. Investigations revealed that medical staff had incorrectly used forceps to speed up delivery when the fetus was not in the correct position. This error, combined with inadequate fetal monitoring, directly contributed to Neizan’s lifelong condition. The awarded compensation will fund specialised care and an adapted living environment for the boy. His parents had sought justice for the preventable harm caused by the hospital’s failures.

The €13.3 million payout sets a legal precedent in Spain for medical negligence cases. The funds will cover Neizan’s ongoing treatment and support needs. The ruling confirms that critical errors in labour management led to his permanent disabilities.
