A regional court in Kazakhstan has overturned a decision to strip a child of disability status. The ruling follows a legal challenge by the boy’s mother, who argued that his condition had not improved. Officials had terminated his benefits in 2021, claiming he no longer qualified for support.
The child was first recognised as disabled in 2018 due to a severe congenital intestinal disorder. Three years later, a medical and social assessment concluded that his condition had changed, revoking his status and cutting off state benefits.
The mother took the case to the Zhetisu Regional Court, insisting her son still needed constant care. Judges found that the 2021 assessment had been carried out with excessive formalism. They ruled the decision unlawful and ordered the reinstatement of disability benefits. The court’s verdict applies retroactively, covering the period from May 14, 2021, to July 17, 2024. Authorities must now recalculate and repay all missed benefits to the family.
The ruling restores the child’s disability status and ensures backdated payments for the affected period. The decision also requires officials to reassess future evaluations more carefully. The family will now receive the financial support they were previously denied.
