A neurosurgeon has been fined after a patient died following neck disc surgery in June 2021. The Incheon District Court ruled that the doctor’s failure to monitor and address a postoperative hematoma led to the fatal outcome. The penalty was set at 15 million won ($10,370).
The incident took place on June 21, 2021, when the patient underwent neck disc surgery. After the procedure, the neurosurgeon left work without ordering or reviewing an X-ray, despite the known risk of bleeding complications. Nurses at the scene later confirmed they had not been instructed to arrange any postoperative imaging.
The patient’s condition worsened overnight due to airway obstruction caused by internal bleeding. By the following day, the patient had died. During the trial, the neurosurgeon argued that a preoperative X-ray had been requested but admitted to not checking the results before departing. The court determined that the lack of proper monitoring and intervention directly caused the death. While the neurosurgeon had no prior criminal record, the ruling took into account a settlement reached with the victim’s family before finalising the fine.
The fine of 15 million won reflects the court’s finding of professional negligence. The neurosurgeon’s failure to ensure postoperative safety measures resulted in a preventable death. The case highlights the importance of thorough postoperative care in surgical procedures.
